Article 1 – Purpose and Scope of Application
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Tykvah, a sole proprietorship run by Nicky Roy TRA, whose headquarters are located at Rue Pasteur, 91360 Épinay-sur-Orge (SIRET 106 711 716 00014), and any person ("the Customer") making a purchase through the Tykvah website (tykvah.com). Any order placed on the Site implies full and complete acceptance of these GTC.

Article 2 – Products
Tykvah offers ready-to-wear items (streetwear/gothic) for sale, presented on the Site with their essential features, prices, and availability. The photographs are non-contractual.

Article 3 – Prices
Prices are indicated in euros, all taxes included. Tykvah being exempt from VAT (Article 293 B of the French General Tax Code), the displayed prices do not include VAT. Delivery charges are specified before order confirmation.

Article 4 – Order
The order is confirmed after payment has been verified. A confirmation email is sent to the Customer. Tykvah reserves the right to cancel any order in case of stock shortages, while immediately informing the Customer.

Article 5 – Payment
Payment is made online at the time of the order, using the payment methods offered on the Site (credit card and other methods secured by Shopify Payments).

Article 6 – Delivery
Products are shipped to the address provided by the Customer when placing the order. Delivery times are given as an estimate and detailed in the Shipping Information. Tykvah cannot be held responsible for delays caused by the carrier.

Article 7 – Right of Withdrawal
In accordance with Articles L.221-18 and following of the Consumer Code, the Customer has a period of 14 days from the receipt of the product to exercise their right of withdrawal, without having to provide a reason. The procedures are detailed in the Returns and Refunds Information.

Article 8 – Returns and Refunds
Returned items must be new, unworn, and in their original packaging. Refunds will be processed within 14 days of receiving the return, using the original payment method.

Article 9 – Legal Warranties
All products benefit from the legal warranty of conformity (Articles L.217-3 and following of the Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the Civil Code).

Article 10 – Liability
Tykvah cannot be held liable for damages resulting from improper use of the products or cases of force majeure.

Article 11 – Personal Data
The processing of the Client's personal data is governed by the Site's Privacy Policy.

Article 12 – Consumer Mediation
In accordance with Article L.616-1 of the Consumer Code, the consumer Client has the right to use a consumer mediator free of charge to amicably resolve a dispute with the seller, after a prior written complaint has been unsuccessful. The mediator can be contacted as follows:

Article 13 – Applicable Law and Disputes
These Terms and Conditions are governed by French law. In case of a dispute, and if it cannot be resolved amicably or via CM2C mediation, the French courts will have sole jurisdiction.
